What the Factors Mean

Since the factor used can mean so much to the calculation, it's interesting to note that what most influences the factor are physical injuries and medical treatment. There is a direct line between this issue and the factor used. So, factors are influenced by:

  • Fault – The other driver's fault is unquestionable.
  • Documentation – Clear medical evidence of injuries using test results and expert testimony.
  • Obvious and Serious – That usually means injuries requiring surgeries, physical therapy, disfigurement, etc.
  • Permanency – While an injury doesn't have to be permanent, the longer it affects you, the higher the factor number. The need for future treatment or permanent injuries may make the factor exceed 5.
